Update on Multi-District Litigation - 6/26/23

On June 22nd, 3M announced a tentative settlement of the MDL claims by public water suppliers that would create a settlement fund of between $10.3 billion and $12.5 billion. The lead negotiator for the plaintiffs was an attorney from one of the law firms on the team representing Princeton in the MDL case.  Much like the proposed DuPont settlement announced on June 2nd, the 3M proposal takes the form of a class action settlement that requires court approval, a process that is likely to extend through late 2023.  Much like the proposed DuPont settlement, the structure of the proposed 3M settlement would use an allocation formula and procedure. The 3M proposal applies only to claims against 3M by public water systems for contaminated drinking water supplies, and does not apply to claims against other defendants.
