PLANNING BOARD   Meeting Minutes--–

June 20, 2019,  7:30 PM

Present were:  Chair John Mirick, Tom Sullivan and Rud Mason. Ian Catlow and Ann Neuburg were absent.

7:30 PM  Opened meeting in Town Hall Annex

ANR plan was submitted by Josh Olsen from Greenstone Realty, LLC for four ANR lots on Worcester Road (across from P.O.) map 15 Lot 46. Assessor’s info listed 20 acres but a survey concluded it was 15+

Board voted all I favor to sign plan and copies, creating three new lots plus original, paid w/check for $300. All have at least 225’ frontage and 2 acres of mostly upland.

Bob Kilgus, 205 Brooks Station Road, was in to discuss Zoning Bylaws under Sect. VII, (A) and (B) which seem to require a special permit from ZBA on a grandfathered house lot (its size no longer meets zoning requirement) when additions are proposed, even when the new construction conforms to current (dimensional) zoning. That is the situation with Mr. Kilgus, who was sent to the ZBA by the building inspector for a special permit. The board will be considering or developing a change or clarification to Sect. VII for next year’s ATM.

Also, board discussed new state law requiring registry of short-term rentals, considered as hotel-type lodging, for any property rented for timeframes of under 31 days. It also requires a room/excise tax (like the hotel tax) for any property rented more than 14 days per year. John M. suggested that the town’s B&B provision may need to be expanded to incorporate short-term rental.

Board considered a greenhouse addition at 52 Hubbardston Road. Owner Erik Garcia has applied for a Special Permit with ZBA under Zoning Sect. VII, 2. (B) and the public hearing is July 10. Property is in the Rural Preservation Overlay District (ROPD). Site plan review is required for changes to properties within the ROPD. After some discussion, board agreed to ask the ZBA to consider the site plan specifications as noted in Zoning Sect. XVI and address those issues as part of their Special Permit. Dr. Garcia will be included on the Pl. Bd. agenda for July 18.
